Petitioners are apprehending their arrest in Pandaul P.S. Case No. 215 of 2015 (G.R. No. 2711/2015) for the offences registered under Section 365 r/w 34 of the Indian Penal Code. Informant is the brother of the accused and in his written complaint he has stated that Krishna Kant Thakur was his younger brother and was mentally sick and he used to do small job for his livelihood. Raghvesh Thakur is his brother and Manoj Thakur is son of Raghvesh Thakur. It has been alleged that they have conspired and got sale deed executed by Krishna Kant Thakur on 5.2.2014 in their favour but consideration money was not paid, as such there was dispute between Krishna

Patna High Court Cr.Misc. No.73 of 2018(5) dt.19-02-2018 2/3 Kant Thakur and the petitioners. It has further been alleged that Krishna Kant Thakur left for Delhi on 10.1.2015 but he did not reach Delhi and they suspected that petitioners have conspired and kidnapped him.

It has been contended on behalf of the petitioners that they have falsely been implicated in this case and Krishna Kant Thakur was mentally sick. It has been admitted by informant that there is land dispute between informant and the accused persons. Petitioners have no criminal antecedent. Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani, in Pandaul P. S. Case No. 213 of 2015 and G.R. No. 2711 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
