JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, three unknown miscreants, on the point of pistol, looted cash and other articles of the informant.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner and till date the petitioner has not been put on Test Identification

Patna High Court CR. MISC. No.38797 of 2021(4) dt.24-02-2022 2/2 Parade. Petitioner claims clean antecedent and is in custody since 03.04.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that looted cash bag, Adhar Card and I.D. of Bharat Finance Company Ltd. have been recovered from the possession of this petitioner.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
