====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Suiya P.S. Case No. 19 of 2019, instituted for the offence under Section(s) 392 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. He has been implicated in the instant case during investigation on the basis that two Mobile phones have been recovered from his possession. Counsel for the petitioner further submits that aforesaid Mobile Phones have never been put on Test Identification Parade. Petitioner is in custody since 11.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.28277 of 2019(2) dt.01-05-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Banka, in connection with Suiya P.S. Case No. 19 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
