Petitioners apprehend their arrest in Shahkund P.S. case no. 79 of 2018 instituted for the offence under Section(s) 341,323,324,325,307 and 504/34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that petitioner no.5 had lodged a case against the informant and the other prosecution party vide Shahkund P.S. case no. 80 of 2018 for assault on him and other family members and burning the dwelling houses. Patna High Court Cr.Misc. No.38176 of 2018(2) dt.03-07-2018 2/3 blast levelling allegation that co- accused Janardhan Paswan assaulted informant on the head with iron rod. The allegation against these petitioners is that they assaulted the nephew of the informant with fists, slaps, bricks and stones. The injury report of nephew of the informant has been annexed as Annexure-3 which shows that he sustained simple injury caused by hard and blunt object on non- vital part of the body In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Shahkund P.S. case no. 79 of 2018, they shall be released on anticipatory bail on furnishing bail bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M. Bhagalpur, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Patna High Court Cr.Misc. No.38176 of 2018(2) dt.03-07-2018 3/3 bond of the petitioners and (3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
