====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 376 and 506 of the IPC. The prosecution story, in brief, is that the informant Radha Kumari aged about 20 years is a student of B.SC.-II. Ram Binay Kumar (petitioner) is also a co-villager of the informant. The petitioner allegedly after taking indecent snaps of the informant, by way of threatening that he will viral the said photographs, sexually exploited for the last two years. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 09.02.2019. The petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.32744 of 2019(4) dt.20-09-2019 2/2 Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The victim was examined by the Medical Officer. The report of the Medical Officer is part of the case diary. The medical examination report does not support the allegation made in the F.I.R.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist, Begusarai, in connection with Beerpur P.S. Case No. 17 of 2019.
