2. The petitioners apprehend arrest in connection with Ahiyapur P.S. Case No. 8 of 2019 instituted under Sections 304 /34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are the co-villagers, who have assaulted the deceased.

4. Considering the fact that the petitioners along with others have assaulted the deceased, this is not a fit case for grant of anticipatory bail.

5. Accordingly, the application stands dismissed.

6. If the petitioners surrender and pray for regular bail

Patna High Court CR. MISC. No.32104 of 2024(3) dt.23-08-2024 2/2 within four weeks from today, the same shall be considered by the Court below considering the fact that the similarly situated co-accused Jagarnath Ray, Vikash Rai @ Vikau Rai and Bindeshwar Rai @ Binda Rai @ Vindeshwar Ray have been granted regular bail by this Court.
