This application for anticipatory bail, arises out of Bandhuwa Kurawa Police Station Case No. 07 of 2019 corresponding to G.R. Case No. 228 of 2019, disclosing offences punishable under Sections 147, 149, 341, 323, 379, 504, 506 and 354 of the Indian Penal Code and Section 3⁄4 Dian

Patna High Court CR. MISC. No.27491 of 2019(2) dt.26-04-2019 2/3 Prohibition Act, 1999.

The First Information Report was registered on 30.01.2019, alleging that on 07.01.2019, the accused persons had assaulted the informant's husband on the allegation that the informant indulges in witchcraft and because of that a child in their family had died. It is alleged that again on 30.01.2019, they started abusing the informant's husband and assaulted him. Considering the general and omnibus nature of allegation and the delay in lodging of the First Information Report, this application is allowed.

Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Bandhuwa Kurawa Police Station Case No. 07 of 2019 (G.R. Case No. 228 of 2019), subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
