Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. Petitioner, who is in custody since 23.12.2020, seeks regular bail in connection with Kharagpur P.S. Case No. 267 of 2020 registered for offences punishable under Sections 376, 420, 120(B), 323 and 504/34 of the Indian Penal Code. Considering the fact that Sri Sanjiv Kumar Singh, learned counsel appearing on behalf of the petitioner as well as Kaushal Kumar Jha, learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.39121 of 2021(4) dt.31-03-2022 2/2 informant submits that both of them should be given last chance to arrive at a mutually agreed terms so that they may not suffer further. In the present case, the matrimonial relationship of the victim as well as the petitioner has been put into jeopardize. The Court below is directed to take statements of the victim and her parents if possible, her husband namely, Pinku Kumar as well as the parents of the petitioner and his wife. If the parties arrive at any such effective measures then the Court below without being prejudiced by its earlier order dated 11.06.2021 may pass a fresh order in accordance with law. With above observation, the present bail application is disposed of.
