The petitioner apprehends her arrest in connection with Madhwapur P.S. Case no. 69 of 2016, registered under Sections 406, 409 and 420 of the Indian Penal Code.
The accusation is that while the fund was allocated for construction of the school building of Upgraded Middle School, Durgapatti, but the building was not constructed by the Mithilesh Kumar, Headmaster and Punita Kumar, Secretary (Petitioner). Learned counsel for the petitioner submits that petitioner is the Secretary of Upgraded Middle School, Durgapatti. Further submission is that, in fact, fund was received for construction of school building by Mithilesh Kumar, Headmaster and now the construction work of the building has been completed, which would

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Benipatti in connection with Madhwapur P.S. Case No. 69 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
