The petitioner seeks bail in Digha P.S. Case No. 63 of 2021, G.R. No. 889 of 2021, registered for the offence under Sections 379, 411, 414 of the Indian Penal Code. As per the F.I.R., petitioner was apprehended with stolen motorcycle and one mobile phone.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and petitioner has been made accused only on suspicion. No case for the theft of the motorcycle, which is said to have been recovered from the possession of the petitioner, has been registered in the police station. Petitioner is in custody since 08.01.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.38812 of 2021(2) dt.13-12-2021 2/2 Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna in connection with Digha P.S. Case No. 63 of 2021, G.R. No. 889 of 2021.
