JUSTICE SUDHIR SINGH ORAL ORDER 10-07-2018 Counsel for the petitioners submits that vide order dated 04.09.2017, the present application was disposed of with a direction to the petitioners to prefer an appeal before the District Appellate Authority, Darbhanga, within a period of thirty days from the date of the order and the same shall be disposed of by the District Appellate Authority, within the statutory period, in accordance with law. Learned counsel further submits that in the cause title/address part of order dated 04.09.2017, the name of petitioner no. 2 has inadvertently been typed as 'Smt. Rekha Kumari' in place of 'Smt. Raksha Kumari'. Due to that very

Patna High Court CWJC No.22844 of 2012(4) dt.10-07-2018 2/2 reason, the petitioner could not file appeal in time before District Appellate Authority, Darbhanga.

From perusal of the record, it appears that the counsel for the petitioner is correct in his submission. Let in the cause title of order dated 04.09.2017, the name of petitioner no. 2 be read as 'Smt. Raksha Kumari' in place of 'Smt. Rekha Kumari'. The petitioner no. 2 is granted further one month time to prefer an appeal before the District Appellate Authority, Darbhanga from today, if not filed, and the same shall be disposed of by the District Appellate Authority, Darbhanga, within the statutory period, in accordance with law. The order dated 04.09.2017 is modified/clarified to extent indicated above.
