The petitioner is in custody in connection with Amarpur P.S. Case No.358 of 2016, Sessions Trial No. 87 of 2019 for the offences under Section 307 of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 17.08.2016.
Considering the period of custody and the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like
Patna High Court CR. MISC. No.28860 of 2019(2) dt.01-05-2019 2/2 amount each to the satisfaction of learned Additional Sessions Judge-IV, Banka, in connection with Amarpur P.S. Case No.358 of 2016, Sessions Trial No. 87 of 2019 with the condition that petitioner shall appear on each and every date fixed by the court below and in the event petitioner is found in influencing the witnesses and in causing the delay in disposal of the case, the court below shall be at liberty to cancel the bail bonds of the petitioner.
