JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-01-2021 Since both the bail applications arises out of the same F.I.R., the same are being taken up together and are being disposed of by this common order.

Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Bahadurpur P.S. Case No. 202 of 2020 for the offence under Sections 302/120B/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.30582 of 2020(3) dt.05-01-2021 2/2 Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent. He further submits that the petitioners were not named in the F.I.R. From the prosecution case, it appears that there was no good relationship of the deceased with her husband and the deceased Sudha Kumari was killed in some other manner. The petitioner of Cr. Misc. No. 30582 of 2020 is in custody since 06.05.2020 and the petitioner of Cr. Misc. No. 35325 of 2020 is in custody since 08.05.2020.

Considering the fact that the petitioners have got no criminal antecedent, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 202 of 2020.
