Petitioner seeks bail in connection with a case registered for the offence punishable u/s 302, 201, 34 of the IPC. 3.

Prosecution case is based on the accusation of killing the deceased by unknown.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He is not named in the FIR and his name transpired in the case on the basis of confessional statement of one of the co-accused namely Kanhayi @ Kanhayi Mandal, who has been granted bail by a co-ordinate Bench of this Court vide order dated 27.04.2023 passed in Cr. Misc. No.2514 of 2023. There is general and omnibus allegation against the petitioner.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Amarpur P.S. Case No.138 of 2017, subject to the condition that he will cooperate in the trial and appear before the Court below on each fixed date and if he fails to appear on two consecutive dates, the bail bond of the petitioner shall be cancelled by the Court below itself.
