The petitioner seeks bail in connection with Raghopur (Rustampur) P.S. Case No. 78 of 2019 for the offence under Sections 304B, 120B and 201 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be husband of the deceased. As a matter of fact, the deceased got burnt while she was cooking and she sustained serious burn injury as a result of which she died during course of treatment. This petitioner has not

Patna High Court CR. MISC. No.29355 of 2020(4) dt.17-02-2021 2/2 played any role in the unfortunate occurrence. He is languishing in judicial custody since 10.11.2019. Learned A.P.P. for the State has opposed the prayer for bail and submitted that the deceased died only after seven days of her marriage and the petitioner is solely responsible for the alleged occurrence.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. (Arvind Srivastava, J) Brajesh/- U T
