In this case, the petitioner is apprehending his arrest in connection with Shyampur Bhatha P.S. Case No. 23 of registered for offences under sections 420/467/468/471/506/34 of the Indian Penal Code. In the present case, an allegation has been made by the Informant that he has small area of land in his native village which the accused persons wanted to purchase and, later on, it transpired that the accused persons have purchased the land from Aditya Kumar Verma and Vikash Kumar Verma who are the not owner of the land.
It has been submitted that the petitioner is not the purchaser but, only a witness to the execution of the sale deed
Patna High Court Cr.Misc. No.36796 of 2018(2) dt.29-06-2018 2/2 and the dispute is as to whether the land, in question, belongs to the Complainant/Informant or Vikash Kumar Verma. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Raj Mangal Singh, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheohar in connection with Shyampur Bhatha P.S. Case No. 23 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
