====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-11-2020 Heard the learned counsel for the parties.

The petitioner seeks bail in connection with Sessions Trial No. 116 of 2020, arising out of Sahajitpur P. S. Case No. 66 of 2019 dated 22.05.2019, instituted for the offences under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 06.02.2020 by Hon'ble Mr.

Patna High Court CR. MISC. No.25285 of 2020(3) dt.09-11-2020 2/3 Justice Vinod Kumar Sinha, J., as he then was. While rejecting the prayer for bail, the Court took note of the fact that the petitioner is not the assailant of the deceased and therefore granted him the liberty to approach the Court for grant of bail again once charges in this case is framed.

It appears that petitioner is not the assailant of the deceased and charges in this case have already been framed which fact stands confirmed by the report which has been sent by the court below.

The learned counsel for the petitioner has further submitted that one of the other co-accused of this case, namely, Chandan Singh has been granted bail by a Bench of this Court.

Considering the afore-stated facts and taking into account the period of custody of the petitioner which is from 18.06.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.25285 of 2020(3) dt.09-11-2020 3/3 each to the satisfaction of the learned Additional Sessions Judge - IX, Saran at Chapra in connection with Sessions Trial No. 116 of 2020, arising out of Sahajitpur P. S. Case No. 66 of 2019.

The petition stands allowed.
