In this case, the petitioner is apprehending his arrest in connection with Marauna P.S. Case No. 93 of 2017 registered for offences under sections 147, 148, 149, 447, 341, 323, 324, 325, 307, 354(A), 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

In the present case, an allegation has been made that the accused persons entered into the house of the Informant and caused injuries using various arms. Specific allegation has been made against the petitioner and one Filzoor to have outraged the modesty of the wife of the Informant. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory

Patna High Court Cr.Misc. No.36586 of 2018(2) dt.28-06-2018 2/2 bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of six weeks from today and prays for bail, the court below, without being prejudiced by this order as also taking into account that one Md. Kamare Alam has been granted bail by this Court, will consider the prayer for bail on the merit of the case.
