IN THE HIGH COURT OF JUDICATURE AT PATNA
Civil Writ Jurisdiction Case No.5882 of 2015 ====================================================== Gopal Singh .... .... Petitioner/s
Versus
Madan Singh & Ors .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Pushpendra Kumar Singh For the Respondent/s : Mr. Nirbhay K.Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 11-04-2016 Heard learned counsel Mr. Vaidehi Raman Prasad Singh for the petitioner and learned A.C. to S.C.26 on behalf of the State of Bihar.
By the impugned order dated 16.01.2015 the leanred Munsif, Pupri at Sitamarhi has held that since there was earlier Pleader Commissioner appointed on the application of the plaintiff, who has already submitted a report, there is no question of appointing further Pleader Commissioner arises in Title Suit No.03 of 2010. Therefore, application filed by the petitioner was accordingly disposed of and directed that if in future it will be necessary it will be considered at the time of judgment. In view of the above observation of the learned court below I do not find it is a case for interference in exercise of supervisory jurisdiction. Thus, this writ application is dismissed.
