The petitioner seeks anticipatory bail in connection with POCSO Case No. 10 of 2018, arising out of Narhat (Sitamarhi) P. S. Case No. 56 of 2018, registered for offences punishable under Sections 366A, 354B/506 of the Indian Penal Code and Section 8 POCSO Act and Section 66 I.T. Act. Allegation against the petitioner is of kidnapping the daughter of the informant and after search the informant came to know that Bhanu Pratap kidnapped the daughter of the informant with the help of his Mama, Mantu Kumar (petitioner). Submission of the learned counsel for the petitioner is that the petitioner is the uncle (mama) of main accused and no specific allegation has been attributed against him, except that he
Patna High Court Cr.Misc. No.38836 of 2018 (3) dt.10-07-2018 2/2 has also taken her along with other accused person and kept her in his house.
Learned A.P.P. opposes the prayer for bail.
In view of the facts and circumstances, discussed above, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by order of this Court.
With the aforesaid observation, this application is dismissed.
