Prayer is allowed. Dismissed as withdrawn.

The petitioner apprehends his arrest in Purnahia P.S. Case No. 48 of 2020, registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.

As per the FIR, there is no allegation of assault

Patna High Court CR. MISC. No.29220 of 2020(3) dt.06-01-2021 2/2 against petitioner no. 2. Allegation of assault is against other coaccused persons. Petitioner no. 2 is only stated to be present at the place of occurrence. There is case and counter case. Petitioner no. 2 has got clean antecedent, as stated in para 3 of the petition.

Considering the facts aforesaid, Sani Kumar petitioner no. 2, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Sheohar in connection with Purnahia P.S. Case No. 48 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
