JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Mairwa P.S. Case No. 79/2020 registered for the offences punishable under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 16 litres of Mahua wine is said to have been recovered from a field and the petitioners are said to have fled away from the place after seeing the police. It is submitted on behalf of the petitioners that nothing has been recovered from the possession of the petitioners and recovery of wine has been made from the field. The petitioners have clean antecedents as stated in paragraph No. 3 of the
Patna High Court CR. MISC. No.29013 of 2020(2) dt.02-12-2020 2/2 petition.
Considering the aforementioned facts and circumstances, the bail application of these petitioners is allowed. Let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II cum Special Judge, Excise, Siwan, in connection with Mairwa P.S. Case No. 79/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Prabhat Kumar Singh, J) Saif/- U T
