JUSTICE SHIVAJI PANDEY ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In the present case, petitioner is challenging the order dated 28.10.2014 passed by the Sub-Divisional Officer, Barsoi, Katihar by which his licence vide Licence No.3 of 2001 has been cancelled.

The petitioner was running a PDS shop. An inspection was made, his shop was found closed and certain irregularities were found of taking extra amount which he has denied but finding has recorded and his licence has been cancelled. In such view of the matter, if petitioner is aggrieved by

Patna High Court CWJC No.3870 of 2015 (2) dt.21-09-2017 the aforesaid order, he must file an appeal before the appellate authority. If the petitioner files an appeal, the appellate authority will dispose of the same in accordance with law. While disposing of the limitation matter the authority will take into account the pendency of the present case before this Court.

With the aforesaid observation and direction this writ petition is disposed of.
