JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 21-08-2023 Heard Mr. Virendra Prasad, learned counsel appearing on behalf of the petitioner and Mr. Anuj Kumar, learned AC to learned GP-24 for the State.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner is entitled for payment of Group Insurance in light of government resolution contained in Memo No. 4185 (2) dated 13.07.1985 and compound interest payable at the rate of 12.5%. He further submitted that petitioner seeks to file a detailed representation along with the calculation chart with his representation before the District Magistrate-cumCollector, Gaya, to take appropriate steps for making payment of dues amount of Group Insurance in accordance with law. He

Patna High Court CWJC No.7295 of 2023 dt.21-08-2023 2/2 further informed that petitioner has already represented before the Circle Officer, Wazirganj, Gaya, however, he has sat over the matter. Petitioner, who is widow of the employee, namely, Late Chandra Shekhar Mishra, who had died in harness in the year 1990 has been left to face financial crisis.

Considering the nature of relief sought for in the present writ petition by the petitioner, who has not been paid due amount of Group Insurance payable to her husband, who had died in harness from the post of Assistant in Circle Office, Wazirganj, Gaya, this Court directs the District Magistrate-cumCollector, Gaya, to call for all the records relating to the deceased employee from the Circle Officer, Wazirganj, Gaya, and ensure to make payment of due amount of Group Insurance along with the statutory interest at the rate applicable in accordance with government resolution as stated above within a period of six weeks from the date of filing of the representation.

4. With above observation and direction, the present writ petition is disposed of.
