JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 24-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the B.S.E.B. The petitioner apprehends his arrest in connection with Barh P.S. Case No.44 of 2013 registered under Sections 147, 341, 323, 353, 307 and 379 of the Indian Penal Code besides Section 135 of the Electricity Act.

The accusation is that in course of raid by the officials of the Electricity Department, the petitioner was found consuming electric energy by putting Tota in L.T. Line. As such, the petitioner caused loss to the Electricity Department worth Rs.1,36,902/-. At that time, the petitioner and others also snatched

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner has falsely been implicated in this and the petitioner was not arrested from the house. Moreover, the petitioner is ready to deposit Rs.1,36,902/- in favour of the Electricity Department.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, District-Patna, in connection with Barh P.S. Case No.44 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C., on submitting the receipt of depositing Rs.1,36,902/- in favour of the Electricity Department.
