JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-10-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of Informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Hajipur Mahila P.S. Case no. 32 of 2017, registered under Section 498(A)/34 of the Indian Penal Code.

The accusation is of torturing of the informant by her husband and other in-laws through various modes and removing her from matrimonial house.

Learned counsel for the petitioner submits that, in fact, due to ill behaviour of the informant, the petitioner filed C.S. Case No. 40 of 2017 on 20.02.2017 in the Court of the Principal Judge, Family Court, Hajipur against his wife (informant) on the ground of desertion due to that reasons only to give undue pressure this case has been filed. Having regard to the facts and circumstances of the case,

Patna High Court Cr.Misc. No.51371 of 2017 (2) dt.31-10-2017 2/2 let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Hajipur in connection with Hajipur Mahila P.S. Case No. 32 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
