The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,327,354(B),435,379 and 504 of the IPC. The prosecution case as per the written report of Jhatki Devi, submitted to the Officer Incharge of Forbesganj (Simraha) Police Station is to the effect that on 15.5.2017 at 8 P.M., with an intention to take possession of the land of the informant, the petitioners and others came armed with lathi and danda and
Patna High Court Cr.Misc. No.61766 of 2017(2) dt.21-12-2017 2/3 assaulted the informant, her husband Ram Briksh Singh, son Raju Singh and daughter Anokhi Kumari, put the curtain made of hut material on fire and disrobed the daughter naked. When the other daughter of the informant Sushma came to rescue, she was also assaulted and disrobed naked. The accused persons also took Rupees Twenty Five Thousand and jewellery worth Rupees Twenty Five Thousand from the box.
It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation has been levelled, which gets reflected from the FIR. Some of the petitioners are accused in two other cases lodged by the informant side. There is counter version of the occurrence also being Forbesganj P.S. Case No. 664 of 2016 registered by petitioner no. 1 against the informant side. The accusation is not specific against the petitioner. It is further submitted that no injury has been caused to any one.
Learned APP submits that the petitioners are alleged to have assaulted the informant, her family members. Considering the omnibus and general nature of accusation levelled in the background of serious litigation between the parties, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12
