The petitioners apprehend their arrest in connection with Runnisaidpur P.S. Case No. 505 of 2018 registered under Sections 363, 366(A), 34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. In fact, there was love
Patna High Court CR. MISC. No.27359 of 2019(2) dt.25-04-2019 2/2 affairs between the daughter of the informant and petitioner no. 5, for which earlier a case was lodged by the informant. The victim in her statement recorded under section 164 Cr. P.C. specifically stated that as per her own consent, she solemnized marriage with petitioner no.5. Her age was assessed by the learned Magistrate about 20 years, as evident from Annexures-2 and 3. Further he submits that the petitioner nos. 3, 4 and 5 have already granted bail by a Bench of this Court in that case, as evident from Annexure-4. The present case is lodged only to harass the petitioners.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi in connection with Runnisaidpur P.S. Case No.505 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
