Counsel for the State points out to the order dated 08.9.2011. He submits that after the aforementioned order, some of the petitioners preferred intra court appeals in which they were unsuccessful. Then they approached the Apex Court in S.L.P.(C) No. 17507 of 2012 and other analogous cases which have now been disposed of on 13.8.2015. In the said SLP also the petitioners were unsuccessful. Consequently, the present order has now merged with the order passed by the Apex Court and cannot be complied with as the petitioners themselves had not cooperated in the counselling which were held thereafter. This Court does not deem it necessary to proceed under the contempt jurisdiction. It is, however, made clear that the
Patna High Court MJC No.2939 of 2013 (5) dt.23-03-2017 State shall be bound by the directions as pointed out by the Apex Court in SLP(C ) No. 17507 of 2012.
With the observations aforementioned, this application is disposed of.
