JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2018 The petitioner is apprehending his arrest in connection with Industrial P.S. Case No. 22 of 2018, registered for offences punishable under Section 392 of the Indian Penal Code and later on added Section 395 and 412 of Indian Penal Code. Allegation as per F.I.R. is that the petitioner entered inside the cabin of the vehicle of the informant and snatched the mobile.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and nothing has been recovered. It has further been submitted that the petitioner has no criminal antecedents.
Heard the learned A.P.P. also.
Having heard both sides, in view of the above facts, let
Patna High Court Cr.Misc. No.37311 of 2018 (3) dt.20-07-2018 2/2 the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IXth, Bhagalpur in connection with Industrial P.S. Case No. 22 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) It is further made clear that the petition in no way shall threaten the informant otherwise the informant may move for cancellation of his bail bonds.
