ABHISHEK REDDY ORAL ORDER 03-05-2024 Learned counsel appearing on behalf of the petitioner has stated that inadvertently the CWJC No. 5049 of 2011 was listed on 19.01.2024, which was dismissed as withdrawn on the prayer of the learned Junior Counsel.

2. As a matter of fact the issue in the present writ petition is pending before the Hon'ble Supreme Court and the learned counsel prays for recalling the order dated 19.01.2024,

Patna High Court C. REV. No.152 of 2024(3) dt.03-05-2024 2/2 whereby the writ petition was dismissed as withdrawn.

3. Having regard to the above made submissions, the order dated 19.01.2024 is recalled and the CWJC No. 5049 of 2011 is restored to its original file.

4. Accordingly, the present Civil Review stands allowed.

5. Registry is directed to re-list the CWJC No. 5049 of 2011 after disposal of SLP(C) No. 021888 of 2012 (Coal India Ltd. vs. M/S Rahul Industries and Ors.).
