In this case the petitioner is making a prayer that that he should be paid the amount of bill for construction of the building of Jawahar Naovday Vidyalaya at East Champaran, Bihar. An advertisement was published for appointment of Contractor, as the petitioner was selected, being L-1, the work was allotted to him. The petitioner entered into agreement being

Patna High Court CWJC No.9762 of 2016 dt.27-02-2017 Agreement No. 06/CE/EE/PCD-II/2010-11, after completion of the work, an inspection was made by the authority concerned wherein it was found that the building has been constructed as per specification, the petitioner submitted the bill but, the payment has not been made to the petitioner to which he is entitled.

Let the Assistant Commissioner, N.V.S. Regional Office, Patna (Respondent No.2) would examine the case of the petitioner, if found that the petitioner is entitled to any such amount, he will be obliged to release the admissible amount to the petitioner to which he is entitled and, further if it is found that there is a dispute, the petitioner will be at liberty to take action in accordance with law. With the aforementioned observation, this application is disposed of.
