JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2018 The petitioners are apprehending their arrest in connection with Bodh Gaya P.S. Case No. 190 of 2018, registered for offences punishable under Sections 341, 323, 354, 506/34 of the Indian Penal Code.
At the very outset, it has been submitted on behalf of the State and the informant is that the petitioners were released on police bail under Section 41(2) of the Cr.P.C. and as such the present anticipatory bail is not maintainable. Submission of learned counsel for the petitioners that they have falsely been implicated in this case and have been on police bail and have not misused the privilege of police bail. Having heard both sides, in view of the above facts, let
Patna High Court Cr.Misc. No.38435 of 2018 (3) dt.26-07-2018 2/2 the petitioners above named surrendered before the Court below and make prayer for regular bail and the court below after considering the fact that petitioners were on police bail shall pass an appropriate order, if possible, on the same day.
