ANJANA MISHRA ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing for the State.

The petitioner is apprehending his arrest in connection with Laxmipur P.S. Case No. 229 of 2015 registered for the offence under Sections 147, 324, 364(A), 307 and 379 of the Indian Penal Code.

The present application for anticipatory bail has been filed after lapse of almost two years without there being any cogent reason for the same. It appears that on 27.09.2016, this Court after considering the case of the petitioner on merit had rejected the application for anticipatory bail and it is truly a matter of concern that despite such order of rejection, the petitioner was not taken into custody nor has he surrendered before the court

Patna High Court Cr.Misc. No.37783 of 2018 (2) dt.04-07-2018 below. It further appears that there is no further reason for reconsidering the case of the petitioner as the second anticipatory bail application is not maintainable. The prayer for anticipatory bail of the petitioner is, thus, rejected once again. The Laxmipur Police Station is directed to take the petitioner into custody and the Superintendent of Police, Jamui is also directed to ensure that the petitioner is taken into custody forthwith.
