The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420/ 467/468/471/120(B) of the Indian Penal Code.
Learned Senior counsel for the petitioner submits that the allegation against the petitioner is that in place of himself, another person had appeared at the Constable examination, as result of which, he had been declared successful. It is further submitted that only on account of the fact that the petitioner has not appeared at the time of such verification, it has been suspected that the petitioner was guilty and is, thus, facing prosecution. Patna High Court Cr.Misc. No.23791 of 2016 (3) dt.06-09-2016 P2/2 submitted that in another case filed before another police station under similar circumstances, this Court has been pleased to extend the benefit of anticipatory bail to the said petitioner of the said case. As such, a similar order in favour of the petitioner granting him pre-arrest bail would sub-serve the purpose of justice. Taking into consideration the facts and circumstances of the case and that the petitioner has been roped in, on account of suspicion, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha P.S. Case No. 480/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
