JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2017 In the present writ application, the petitioner has sought for quashing of the Letter contained in Memo No. 245 dated 01.11.2012 issued by the Executive Officer-cum-Member Secretary, Block Teachers Appointment Committee, Kargahar, Rohtas, respondent no. 8 by which the service of the petitioner as Block Teacher at Upgraded Middle School, Kudiyari, Kargahar, has been terminated.

The petitioner is directed to prefer an appeal before the District Appellate Authority, Rohtas at Sasaram, within a period of

Patna High Court CWJC No.23158 of 2012 (4) dt.09-08-2017 2/2 thirty days from the date of the order, which shall be disposed of in accordance with law within the statutory period. It has been submitted by learned counsel for the petitioner that the petitioner was granted interim relief by this Court on 03.01.2013. The petitioner will be at liberty to file a separate application before the District Appellate Authority, Rohtas at Sasaram, if so advised, for any interim relief during the pendency of the appeal, within a period of ten days from the date of filing of the appeal. The said application filed by the petitioner shall be disposed of within a period of twenty days. It has further been submitted by learned counsel for the petitioner that the salary of the petitioner may be paid for the period for which he has worked as a Block Teacher from July, 2010 to 01.11.2012.

The submissions made by learned counsel for the petitioner regarding payments of salary may be considered by the District Appellate Authority, Rohtas at Sasaram, in accordance with law.

With the aforesaid observations and directions, the present writ application stands disposed of.
