The petitioner is in custody in connection with Khushrupur P.S. Case No.297 of 2018 for the offences under Sections 399, 402, 411, 413, 414 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.

Allegation against the petitioner is that he along with some miscreants gathered and were planning to commit dacoity. Learned counsel for the petitioner submits that nothing incriminating was recovered from the conscious possession of this petitioner. He further submits that petitioner is in custody since 23.11.2018.

Considering the fact that petitioner has remained in custody for more than five months, the Court is inclined to grant

Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Patna City, Patna, in connection with Khusrupur P.S. Case No. 297 of 2018.
