2. The petitioner has preferred this application for grant of regular bail in connection with Banka P.S. Case No. 131 of 2024 dated 01.04.2024 registered for the offences punishable u/ss 147, 148, 149, 448, 341, 323, 427, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, on 24.03.2024, on previous land, the petitioner and the co-accused persons armed with sharp cutting weapon entered the informant's house and started abusing the informant's mother. On being objected by the informant's mother, the petitioner and the co-accused, Arvind Yadav assaulted her with rod and farsa. The informant's mother

No.29308 of 2025(2) dt.07-05-2025 2/3 raised alarm, the informant came to rescue her then the coaccused, Laloo Yadav and Girdhari Yadav armed with pistol entered the house and fired on the informant with an intention to kill her which caused injury on the ear of the informant and she fell down on the ground. It is further alleged that the coaccused, Gajo Yadav and Najo Yadav assaulted the informant's daughter with rod and sticks on her hand and leg due to which she sustained injury.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The allegation against the petitioner is of assaulting the informant's mother and as per the injury report of Reshmi Devi, she sustained one injury and the injury is grievous in nature which is on non-vital part of the body. There is no allegation of firing against the petitioner. The petitioner has no concern with the alleged offence. The co-accused persons have already been granted anticipatory bail by the Coordinate Bench of this court vide order dated 07.02.2025 passed in Cr. Misc. No. 89222/2024. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 19.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Banka P.S. Case No. 131 of 2024.
7. The application stands allowed.
