Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354, 370, 368, 342, 294, 120(B) of the Indian Penal Code.

The prosecution case as per F.I.R is that the

No.38896 of 2021(3) dt.27-04-2022 2/3 informant received information from local residents of Rajgir Bazar that some local residents are indulged in performing obscene dances in the name of Orchestra from the girls outside State. On the basis of such information, raid was conducted and from the house of the petitioner, four girls were recovered. Accordingly, the girls were also recovered from the houses of other accused persons.

It is submitted by learned counsel for the petitioner that petitioner possess two houses, out of which, one house was given by the petitioner on rent to the ladies who were presented themselves as artists and stated that they stayed here for work purposes. It is further submitted that none of the ladies has filed any complaint against the petitioner nor they have ever given any statement to the police so far as the present case is concerned. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let

No.38896 of 2021(3) dt.27-04-2022 3/3 the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 62 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
