JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354(A), 379, 504, 506, 34 of the Indian Penal Code. The prosecution case is that the petitioners and others entered into the house of the informant on 18.11.2015 and started abusing and assaulting her. The accused persons were putting pressure to withdraw the earlier case filed for kidnapping of the daughter of the informant. It is submitted by learned counsel for the petitioners that maliciously the petitioners have been roped in the present case. The petitioners were not accused in the case lodged earlier by the informant for the kidnapping of her daughter. The daughter of the informant in her 164 Cr.P.C statement has not alleged anything against the petitioners. It is

Patna High Court Cr.Misc. No.25386 of 2016 (2) dt.22-06-2016 2/2 further submitted that co-accused Ram Balak Paswan has filed Manpur P.S. Case No. 128 of 2015 against the agnates of the informant, hence as a retaliatory measure the present case has been lodged.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the accusation being omnibus and general and petitioners having no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Manpur P.S. Case No. 129 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
