The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Hawai Adda P.S. Case No. 83 of 2021 instituted for the offence under Section 419, 420, 467, 468, 120(b) of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981.

Prosecution case relates to committing forgery in an exam resulting into mismatch of thumb impression of the petitioner at the time of counseling.

Patna High Court CR. MISC. No.29200 of 2022(2) dt.18-10-2022 2/3 Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Altogether three times biometric impression of the petitioner has been matches and lastly while he was appearing for counseling, his biometric thumb impression has not been matches, which creates doubt on Biometric Thumb Impression Machine. Petitioner has not received any wrongful gain. He is a man of clean antecedent.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Hawai Adda P.S. Case No. 83 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like
