The petitioners are apprehending their arrest in connection with Paliganj P.S. Case No. 295 of 2017, registered for offences punishable under Sections 341, 323, 379 and 506/34 of the Indian Penal Code.
The prosecution case as lodged by the informant on 22.11.2017 that the petitioners taking away the paddy forcibly from his farm, then the informant along with others raised objection and they assaulted the petitioner. It has further been alleged that 17 bags of paddy was recovered from the house of petitioners.
Patna High Court Cr.Misc. No.31456 of 2018 (2) dt.23-05-2018 2/2 Learned counsel for the petitioners submit that 17 paddy bags has been seized and recovered from the possession of the petitioners belongs to them. It has further been submitted that the petitioners have no criminal antecedents and they are farmers and co-villagers.
Considering the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each in connection with Paliganj P.S.Case No. 295 of 2017 to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur, Patna, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code.
