JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2016 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 420 and 468 of the Indian Penal Code.
Prosecution case is that the complainant's lands were being transferred in favour of her daughter and son-in-law namely Najboon Khatoon and Master Abdul Rub Ansari @ Master Abdul Khan Ansari. It is alleged that petitioner no.1 being deed writer and petitioner nos.2 and 3 facilitated such transfer. It appears from the impugned order that learned Additional Sessions Judge - II, Patna has disposed of the anticipatory bail application of the petitioners since only summons have been issued. This fact has not been controverted by learned
Patna High Court Cr.Misc. No.28780 of 2016 (3) dt.27-07-2016 2/2 counsel appearing on behalf of the petitioners. In view of the ratio laid down in the case of Salim Ansare @ Md. Salim Ansare and Others Vs. The State of Bihar & Another reported in 2015(3) PLJR, 806 (Criminal Miscellaneous No.51075/2014), let the learned Court below consider the prayer for regular bail of the petitioners and preferably disposed of on the same day, if the petitioners surrender within a period of six weeks in connection with Complaint Case No.19(C) of 2015, pending in the Court of learned SDJM, Masaurih.
With the above observations, the application stands disposed of.
