Petitioner, Deepak Yadav @ Deepak Kumar seeks bail in Dobhi (Sherghati) P.S. Case No.286 of 2019, registered under Section 395 of the Indian Penal Code.

The informant alleged that while he was going on his pick up van bearing Registration No.JH-13D-7253, the criminals over took his pick up van and looted money, mobiles and they also took away the pick up van.

Learned counsel for the petitioner submits that the FIR is against unknown. Name of the petitioner figured in the case in the confessional statement of co-accused Munarik

Patna High Court CR. MISC. No.25214 of 2020(2) dt.29-09-2020 2/2 Yadav. The petitioner was arrested on 03.01.2020. The petitioner is in custody for last nine months but the petitioner has not been put on TIP. No incriminating article has been recovered from possession of the petitioner. The petitioner has of course got criminal antecedents but in all the cases, the name of the petitioner surfaced in the case on the basis of confessional statement.

Taking into consideration the facts that name of the petitioner surfaced in the case in the confessional statement of co-accused but the petitioner is in jail since 03.01.2020 and he has not been put on TIP even though he is in custody for last nine months, petitioner, namely, Deepak Yadav @ Deepak Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, District Gaya in connection with Dobhi (Sherghati) P.S. Case No.286 of 2019.
