JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 06-02-2015 Heard learned counsel for the petitioner and the State. This is a peculiar case in which the petitioner claims that though his vehicle was engaged for a period commencing from 08.02.2012 to 08.04.2013 on payment at the rate of Rs. 725/- per day, he has been compelled to move from pillar to post for his due payment.

It appears that the District Supply Officer, Sheohar had written to the Government for necessary allotment on 01.11.2012 vide Annexure 3 so that the payment could be made to the petitioner. However, according to the petitioner, nothing has been done till date. The petitioner has also approached the District Magistrate but without

If the petitioner's claim is correct then it is very unfortunate that even though his vehicle has been hired and utilized by the State authority but no payment is being made thereafter and the person concerned has been compelled to move from pillar to post for getting his legal dues.

In above view of the matter, I deem it desirable to direct the Principal Secretary, Food and Supply Department, Government of Bihar, Patna, i.e., the respondent no. 2, to look into the matter and consider the claim of the petitioner and, thereafter, take a final decision in the matter and in case it is found that some amount is due to be paid to the petitioner then steps should be taken for its immediate payment. The petitioner would be required to file a detailed representation along with necessary documents etc., if any, before the Principal Secretary, Food and Supply Department, Government of Bihar, Patna, thereafter, a decision should be taken by him. The entire exercise should be completed within a period of two months from the date of filing of such representation along with a certified copy of this order.
