JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioners seek bail in anticipation of their arrest in connection with Amarpur P.S. Case No. 519 of 2017, dated 18.10.2017, instituted for the offences punishable under Sections 147, 148, 341, 323, 324, 308, 504 and 506/34 of the Indian Penal Code.

The petitioners along with others are alleged to have assaulted the informant and the other members of the family.

Patna High Court Cr.Misc. No.31442 of 2018 (3) dt.28-06-2018 2/3 Mr. Ajay Mukherjee, learned Advocate appearing for the petitioners has submitted that there is a counter version of the occurrence also. He has also submitted that the dispute between the two families is because of the intention and attempt of the informant to have the property of the petitioners appropriated in their absence. The father of the petitioners had died long time ago and the mother has been staying in the village all alone. Only for the purposes of ousting the petitioners from the family/village property, such machinations are being resorted to. So far as injuries on the persons of the victims are concerned, except for one of the injuries on the person of Anita Devi (informant), all other injuries are found to be simple in nature. One of the grievous injuries found on the person of Anita Devi is on a non-vital portion of her body. The petitioners do not have any criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released o n bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount

Patna High Court Cr.Misc. No.31442 of 2018 (3) dt.28-06-2018 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 519 of 2017.
