JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date : 19-09-2017 Learned senior counsel for the petitioner informs the Court with due evidence that the State LPA has already been dismissed for default way back on 16.11.2016. There is no input that any steps have been taken for restoration of said LPA. If that be so, the order of the learned Single Judge passed in CWJC No.1517 of 2006, dated 22.06.2012, which had set aside the order of dismissal of the husband of the petitioner and Annexure- 6 to the said writ application having been quashed, the right of the present petitioner, who happens to be wife of the erstwhile employee to demand payment of salary, death- cum- retiral benefits etc., stands.

Patna High Court CWJC No.23769 of 2012 dt.19-09-2017 2/2 In view of the same, the writ application is disposed of with a direction upon respondent no.2 that the claim of the present petitioner shall be worked out and settled in her favour within a period of three months. However, they may have a right to revisit that decision provided they succeed in getting any order in the LPA, if it is revived at all. Writ stands disposed of in terms of the above direction.
