JUSTICE SANDEEP KUMAR ORAL ORDER 16-08-2023 This is an application for quashing the F.I.R. of Minapur P.S. Case No. 359 of 2020 registered for the offences under Sections 147, 149, 188, 269, 370, 271, 341, 353 and 34 of the IPC.

2. As per the prosecution case, the allegation against the petitioner is that he along with Md. Sajmul violated the rules of the government regarding gathering of crowd during COVID-19 period.

3. Learned counsel for the petitioner submits that the petitioner is quite innocent and has not violated any rules.

4. Learned counsel for the O.P. No. 2 has vehemently opposed the prayer of the petitioner.

5. I have heard both the parties.

6. From perusing the materials available on record, no ground for interference is made.

7. In view of the law laid down by the Hon'ble Supreme Court in the case of Neeharika infrastructure pvt Ltd. V. State of maharshtra and others (2020) 10 SCC 118, this application is dismissed.
