JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 23-07-2025 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Khagaria P.S. Case No. 22 of 2025, instituted under Sections 109, 303(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1-B)(i), 26, 27 and 35 of the Arms Act.
3. As per the prosecution case, on the date of occurrence all the F.I.R. named accused persons including the petitioners and unknown armed with weapon came at the house of informant. It is alleged that co-accused Chandradev Yadav and Manohar Yadav made indiscriminate firing which hit the
Patna High Court CR. MISC. No.30152 of 2025(3) dt.23-07-2025 2/3 right leg of the informant's wife and she fell down. Co-accused Amit Kumar and Ladoo Kumar also made firing which crossed from the side of her temple tearing her saree. The accused persons also snatched the golden chain from neck of the informant's wife.

Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to village politics and land dispute between other coaccused with the informant. He further submits that there is no specific allegation against the petitioners except that they were part of the mob. There is no allegation of any overt-act against the petitioners. Allegation of firing upon the wife of informant is against co-accused Chandradev Yadav and Manohar Singh. Petitioners have one criminal antecedent. Petitioners undertake to co-operate in the investigation and trial.
5. Learned A.P.P. for the State assisted by learned counsel for the informant oppose the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon
Patna High Court CR. MISC. No.30152 of 2025(3) dt.23-07-2025 3/3 furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria P.S. Case No. 22 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
