The petitioner is apprehending his arrest in connection with Khaira P.S.Case no.264 of 2018 , registered for offences punishable under Sections 341, 323, 504, 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.. Allegation against the petitioner, who happens to be husband, is of demand of Rs.1,50,000/- and a motorcycle and for that ousting her from the house.

Submission of the learned counsel for the petitioner is that as a matter of fact she gave birth to a child only after six months of the marriage, which appears from the FIR itself and the petitioner apprehends her relationship with some other

Patna High Court CR. MISC. No.32650 of 2019(2) dt.17-05-2019 2/2 persons and due to that there is dispute. Petitioner is still ready to keep her if she breaks up relationship with her friend. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Khaira P.S.Case no.264 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
